Terms of Service

By using ArkHost services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

You must be at least 18 years old, or have parental/guardian consent to use our services.

We provide:

• Shared web hosting
• Hosted email services
• Virtual Private Servers (VPS)
• Domain registration and transfer
• SSL certificates
• WHMCS modules and licenses

Specific services may have additional terms that apply.

Accepted payment methods:

• Mastercard / Visa
• PayPal
• Bancontact
• Prepaid account credits

Prices are displayed in EUR or USD. Applicable taxes (VAT) will be added. You must keep your account and payment information up to date. Services are billed automatically according to your billing cycle. We reserve the right to change prices with notice. We may refuse any order at our discretion.

All content on this website (text, graphics, logos, software) is owned by ArkHost or licensed to ArkHost. You may not copy, reproduce, or redistribute without written permission.

You may not use ArkHost services for any illegal, abusive, or harmful purpose. Specifically, you may not:

• Send spam or unsolicited bulk email
• Collect user data without consent
• Host malware, phishing sites, or illegal content
• Violate applicable laws or regulations
• Harass, threaten, or abuse others
• Attempt to bypass security measures
• Reverse-engineer our software
• Overload our network or systems
• Impersonate others
• Use automated tools to abuse our services

You may cancel your services at any time through your client area. Cancellations take effect at the end of your current billing period.

Refund policy:

• No refunds for partial billing periods
• Annual plans: Pro-rata refund if cancelled within 30 days
• Setup fees and domain registration fees are non-refundable

We may suspend or terminate your account without notice if you violate these terms. Using ArkHost services for spam will result in a €100/hour charge for blacklist removal work.

9.1 Data Protection

We comply with GDPR and Belgian data protection law. See our Privacy Policy for full details on how we handle personal data.

9.2 Data Processing Agreement

When you use our hosting services, we act as a data processor for any personal data you store on our infrastructure. Our relationship is governed by our Data Processing Agreement (DPA), which you can accept in your client area. By using our services, you authorize us to engage the subprocessors listed in our Privacy Policy.

9.3 Data Retention

We retain account data for up to 3 years after account termination. Invoice records are retained for 7 years as required by Belgian law. You may request deletion of your personal data at any time through the Data Privacy section in your client area.

9.4 Your Rights

Under GDPR, you have the right to:

• Access your personal data
• Correct inaccurate data
• Request deletion of your data
• Export your data (portability)
• Restrict or object to processing

9.5 Security

We implement appropriate security measures including encryption (TLS/SSL), Imunify360 server protection, regular backups, and access controls. No system is completely secure.

As a user, you agree to:

• Provide accurate account information
• Keep your login credentials secure
• Comply with all applicable laws
• Respect the rights of others
• Report any security incidents promptly
• Maintain your own backups of critical data

We target 99.9% uptime for our shared hosting and VPS infrastructure, excluding scheduled maintenance. Critical support tickets receive a response within 1 business day.

Backups are provided on a best-effort basis depending on your plan. We recommend maintaining your own backups. Compensation for extended outages is handled on a case-by-case basis.

To the maximum extent permitted by law, ArkHost is not liable for indirect, incidental, special, or consequential damages. Our total liability is limited to the amount you paid us in the 6 months preceding the claim.

You agree to indemnify and hold ArkHost harmless from any claims, damages, or expenses arising from your use of our services or violation of these terms.

Our services may integrate with or link to third-party services. These services have their own terms and privacy policies. We are not responsible for third-party services.

We are not liable for failures or delays caused by circumstances beyond our reasonable control, including natural disasters, war, government actions, power outages, or internet disruptions.

ArkHost WHMCS modules are licensed under the following terms:

• License duration: 1 year from purchase date
• Updates: All updates and security patches included during active license
• Encoding: Modules are ionCube encoded for intellectual property protection
• Installation: Each license covers one WHMCS installation only
• Support: Technical support provided during active license period
• Renewal: License renewal required for continued use after expiration

Modules will cease to function after license expiration. Contact support@arkhost.com for renewals.

These Terms of Service are governed by Belgian law. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Ghent, Belgium.

We may update these terms from time to time. Changes take effect when posted. For significant changes, we will notify you via email. Continued use of ArkHost services after changes constitutes acceptance of the new terms.
